E.I. DU PONT DE NEMOURS AND COMPANY Sued Yingpeng Chemical Co., Ltd.

E.I. DU PONT DE NEMOURS AND COMPANY (the plaintiff) brought before Jinhua Municipal Intermediate People's Court in Zhejiang Province a lawsuit of patent infringement. The court was requested to order Yingpeng Chemical Co., Ltd. (the defendant) to stop making, selling, offering to selling infringing goods, make compensation for economic losses of 9 million CNY, and pay the reasonable expenses incurred in investigating and stopping the infringement as well as all litigation fees.
The plaintiff enjoys patent right for his invention of Constant Boiling Compositions of Fluorination Hydrocarbons. This constant boiling mixture is a kind of azeotropic or azeotropic-like constant boiling mixture comprising about 10-90 weight percent HFC-125 and about 90-10 weight percent HFC-32. Its pressure difference between dew point and bubble point pressures at 25℃ is smaller than 3%.
The defendant produced and sold a kind of fluorinated refrigerant named R410A. It comprises 49.97% HFC-32 and 49.67% HFC-125. Its pressure difference between dew point and bubble point pressures at 25℃ is certainly smaller than 3%.
On November 25, 2008, an agreement was reached via court's mediation. The defendant agrees to immediately stop the suspected infringing acts and promise not to infringe the plaintiff's patent right any more. The defendant also agrees to compensate for the plaintiff's economic losses of 1.257131 million CNY and the relevant litigation fees of 42,869 CNY.
